Fincher Terms of Service
Effective date: July 27, 2026
Welcome to Fincher. These Terms of Service ("Terms") are an agreement between you and Fincher ("Fincher", "we", "us", or "our"), operated by an independent developer based in the United States. They govern your use of the Fincher mobile application and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy (fincher.app/privacy). If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Fincher. By using the Service, you represent that you are 13 or older and that you are legally able to enter into this agreement. If you are under the age of majority where you live, you may use Fincher only with the involvement of a parent or guardian.
2. Your Account
You are responsible for your account and for keeping your sign-in credentials secure. You agree to provide accurate information, not to impersonate any person or entity, and not to create accounts through automated means. Notify us at contact@fincher.app if you believe your account has been compromised.
3. Your Content
You own what you post. Posts, comments, reviews, ratings, diary entries, profile information, and images you upload ("Your Content") remain yours.
License to us. So that we can operate the Service, you grant Fincher a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt (for example, formatting or generating share cards), publish, translate, display, and distribute Your Content in connection with operating, providing, promoting, and improving the Service. This includes publishing Your Content (in whole or in part, with your username and avatar) on Fincher's own social media channels to promote a film, show, the Service, or our community, provided we never use Your Content in a misleading way. This license also includes sublicensing to the service providers that power Fincher (such as our feed and AI-processing providers) solely to provide their services to us. The license ends when you delete Your Content or your account, except (a) where Your Content has been shared with others who have not deleted it (for example, comments on a deleted thread may be removed alongside it, but share images you exported persist wherever you sent them), and (b) for limited retention as described in our Privacy Policy.
Public by design. Fincher is a public platform. Your Content and profile are visible to other users. Do not post anything you are not comfortable making public.
Automated processing. You understand and agree that the text of posts is automatically processed, including by third-party AI services, for spoiler detection and, on request, translation, as described in our Privacy Policy.
Responsibility. You are solely responsible for Your Content. You represent that you have all rights necessary to post it and that it does not violate these Terms or any law.
4. Community Rules
Fincher exists for conversation about film and television. You agree not to post or do any of the following:
- Harassment, bullying, threats, or hate speech directed at any person or group;
- Sexually explicit content; any content that sexually exploits or endangers minors. We have zero tolerance for such content: when we become aware of apparent child exploitation, we report it to the relevant authorities in compliance with applicable laws;
- Content that is illegal, defamatory, fraudulent, or that infringes anyone's intellectual property or privacy rights;
- Coordinated or bad-faith manipulation of ratings or discussion, including participating in orchestrated campaigns against a film, show, or filmmaker ("review bombing"), or otherwise gaming the Service's ratings, quests, or other mechanics;
- Artificially inflating your account's popularity, such as mass-following accounts or mass-liking content to generate reciprocal engagement;
- Spam, scams, deceptive practices, or unauthorized advertising;
- Impersonation of any person, brand, or entity, or misrepresentation of your affiliation;
- False or malicious reports about other users or their content, or misleading our moderation processes;
- Malware, or any attempt to disrupt, overload, scrape, data-mine, reverse engineer, or gain unauthorized access to the Service;
- Evasion of moderation actions (for example, creating new accounts after a suspension).
Off-topic content may be removed at our discretion; Fincher is a place for talking about movies and TV.
In particular, we maintain a zero-tolerance policy against child sexual abuse material (CSAM) and child sexual abuse and exploitation (CSAE). Reports involving apparent CSAM are escalated to law enforcement and, where applicable, the National Center for Missing & Exploited Children (NCMEC), consistent with 18 U.S.C. § 2258A.
5. Moderation, Reporting, and Enforcement
We provide tools to report posts, comments, and users, and to block users so their content and interactions no longer reach you. Posts are automatically screened for spoilers and may be blurred pending user choice.
We may, at our sole discretion and without prior notice, remove or restrict any content, limit features, suspend, or terminate any account that we believe violates these Terms, poses a risk to users or the Service, or as required by law. We review reports of objectionable content and aim to act on them promptly, including removing violating content and ejecting offending users. We are not obligated to pre-screen content, and we are not responsible for content posted by users.
6. Third-Party Content and TMDB
Movie and TV titles, posters, backdrops, and metadata displayed in Fincher are supplied by third parties and remain the property of their respective owners. This product uses the TMDB API but is not endorsed or certified by TMDB. Fincher is not affiliated with any film studio, network, or streaming service.
7. Copyright Complaints
We respect intellectual property rights and expect users to do the same. If you believe content on Fincher infringes your copyright, send a notice to contact@fincher.app including: (a) identification of the copyrighted work; (b) identification and location of the allegedly infringing material; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; (e) a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and (f) your physical or electronic signature. We will remove infringing content and may terminate the accounts of repeat infringers.
8. License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Fincher app for your personal, non-commercial use, subject to these Terms. All rights not expressly granted are reserved. The Fincher name, logo, and app design are our property; nothing in these Terms grants you rights to use them.
9. Feedback
If you send us ideas, suggestions, or other feedback about Fincher, you agree that we may use it freely, without restriction or compensation, and that it is not confidential. We may already have similar ideas under consideration or in development.
10. Termination
You may stop using Fincher and delete your account at any time (Profile → Settings → Account → Delete account). We may suspend or terminate your access as described in Section 5. Sections that by their nature should survive termination (including Sections 3, 6, 7, 9, 11, 12, 13, and 14) survive.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure, that content (including automated spoiler detection and translation) will be accurate or complete, or that any content will be preserved. Automated spoiler detection is best-effort: some spoilers may not be caught, and some non-spoilers may be flagged.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINCHER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US $50) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you; in that case, our liability is limited to the fullest extent permitted by your local law. Nothing in these Terms limits liability that cannot be limited by law, or affects statutory consumer rights you hold under your local law.
13. Indemnity
To the extent permitted by law, you agree to indemnify and hold Fincher harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any third party's rights.
14. Apple App Store Terms
If you use Fincher on an Apple device: these Terms are between you and Fincher only, not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to it, including product liability, legal compliance, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
15. Changes to the Service and These Terms
Fincher is a new and evolving service; features may change, be added, or be removed at any time. We may update these Terms from time to time. If we make material changes, we will notify you in the app or by other reasonable means before they take effect. Your continued use of the Service after changes take effect means you accept the updated Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules, and you agree that disputes will be resolved in the state or federal courts located in Dallas County, Texas, except where the law of your country of residence grants you mandatory protections or venue rights that override this choice.
17. General
These Terms and the Privacy Policy are the entire agreement between you and Fincher regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a transfer of the Service.
